This is the second attempt on behalf of the petitioner for grant of bail in connection with Kudhani P.S. Case No.457 of 2023 registered for the offence under sections 302/120-B/34 of the Indian Penal Code. Earlier, the prayer of the petitioner for grant of bail has been rejected by this Court vide order dated 08.05.2024 passed in Criminal Miscellaneous No.21568 of 2024.

The dead-body of the son of the informant was recovered from a canal. Subsequently, the witnesses have stated that the deceased was seen with the petitioner and one Deepak Kumar.

The petitioner is in custody since 18.11.2023.

Considering the period of custody of the petitioner and also the delay in trial, this bail application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 1st, West Muzaffarpur/concerned Court below, in connection with Kudhani P.S. Case No.457 of 2023, subject to the condition that he will cooperate in the trial and will appear himself or through his lawyer on each and every date fixed in the trial.
