2. The petitioner apprehends his arrest in connection with Doriganj P.S. Case No. 160 of 2025 for the offence registered under sections 331(4), 305 of the BNS, 2023.

3. As per the prosecution story, the informant alleged that while she was sleeping, heard some sound in the house but remained asleep. In the morning, found a suitcase with ornaments missing. Upon watching the CCTV of her neighbor, this petitioner was seen running from the place. This led to the FIR.

4. Learned counsel for the petitioner submits that though he is present in the CCTV, the allegation of suitcase in the FIR has not been found in his hand nor anything recovered

5. Learned APP opposes the prayer submitting that in the CCTV footage, he has been found running away.

6. Considering the submissions of the parties as also the Pen Drive that is part of the Police investigation, this is not a fit case for anticipatory bail.

7. It is accordingly rejected.

8. However, if the petitioner surrenders within four weeks from today, the Court concerned shall take up the matter and dispose it of preferably on the same day. (Rajiv Roy, J) Vijay Singh/- U T
