JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code.

One motorcycle suspected to be stolen, seized from Sintu Kumar, who was allowed to bring the paper of the motorcycle, who suggested that the motorcycle was given to him by this petitioner.

It is submitted by learned counsel for the petitioner that seizure was made on 31.08.2014 for which the FIR was lodged on 26.09.2014. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the delayed nature of accusation, let the

P.S. Case No. 391 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. Learned counsel for the petitioner is permitted to make necessary correction in the petition.
