The Petitioner seeks bail in Rafiganj P.S. Case No. 121 of 2016 registered for the offence punishable under Section 395 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that from perusal of the FIR as well as case diary no any sufficient evidence has been found against the petitioner regarding the involvement in the aforesaid alleged occurrence except confessional statement. The petitioner is in custody since, 02.01.2017, and has got no criminal antecedent. Some of the coaccused persons have been granted bail by a co-ordinate bench of this Court vide orders dated 03.05.2017 in Criminal Miscellaneous No. 17597 of 2017 and dated 26.04.2017 in Criminal

Patna High Court Cr.Misc. No.26145 of 2017 (2) dt.07-06-2017 2/2 Miscellaneous No. 16596 of 2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Rafiganj P.S. Case No. 121 of 2016.
