The petitioner is seeking regular bail in connection with Sessions Trial Case No. 41 of 2017 / 367 of 2016 arising out of Paraiya P.S. Case No. 17 of 2016, registered for the offence punishable under Sections 25(1-b)/26/35 of the Arms Act and Section 17 of the Criminal Law Amendment Act. Perused the status report, from where it appears that five witnesses have already been examined and rest official witnesses are yet to be examined.

Looking to the nature of allegation, this Court is not inclined bail to the petitioner. However, this court directs the Senior Superintendent of Police, Gaya to ensure the production of the witnesses within a period of three months

Patna High Court Cr.Misc. No.13808 of 2018(4) dt.11-04-2018 2/2 from the date of receipt / production of a copy of this order. In failure to produce the prosecution witnesses, this Court will take serious view of the matter and it will be treated to be disobedience of the order of this Court and this Court may initiate a contempt proceeding against him. In turn, the court below will complete the trial within a period of five months thereafter.

Let a copy of this order be communicated to the Senior Superintendent of Police, Gaya.
