NILU AGRAWAL ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner is languishing in judicial custody since 21.02.2017 in connection with Dandkhora P.S. Case No. 66 of 2016 registered for the offence punishable under Sections 304(B), 201/34 of the Indian Penal Code.

The prosecution case, as lodged by the informant, is that his sister was married to one Pramod Kumar Sah four years ago and was subjected to torture at her matrimonial house on account of non-fulfilment of demand of dowry by all the family members. On the fateful day, informant got message on mobile from the petitioner that his sister is traceless and later on, she was found in a burnt condition on the bank of the river.

No.26146 of 2017 (3) dt.06-07-2017 2/2 It has been submitted by the learned counsel for the petitioner that he is the dewar of the deceased, Khushboo Devi and is innocent and only general and omnibus allegation has been levelled against him. He submits that the husband is in custody and that there is no eye-witness to the alleged occurrence and he is living separately from his brother and his family. However, learned A.P.P. for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Dandkhora P.S. Case No. 66 of 2016.
