This application is for grant of regular bail in connection with Baligaon P.S.Case No.12 of 2016, S.T.No.409 of 2016, for the offences punishable under Sections 376 and 302 of the Indian Penal Code.

Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 17.1.2017 passed in Cr. Misc. No.43916 of 2016 with an observation that he is in custody for more than one year.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, a report was called for from the learned trial court

Patna High Court Cr.Misc. No.26151 of 2017 (3) dt.26-07-2017 2/2 and the learned trial court submitted a report stating that altogether 11 witnesses have been examined and the case is pending for examination of few witnesses and he has further ensured that the trial will be concluded within a period of three months.

In such view of the matter, I am not inclined to grant bail to the petitioner rather the learned trial court is directed to conclude it within a period of three months as assured by him. With the aforesaid observation, this application is dismissed.
