JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-04-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 8(c)/21(b) of N.D.P.S. Act. Fifteen Gram brown sugar is said to have been recovered from conscious possession of the petitioner. Submission on behalf of the petitioner is that the mandatory provisions of N.D.P.S. Act have not been complied with by the concerned official at the time of search and seizure and, moreover, petitioner does not have any criminal history and is languishing in jail custody since 16.11.2018. Regard being had to the above-stated facts and circumstances, I am not inclined to release the petitioner on bail.
