====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-07-2026 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 87, 3(5) of the Bharatiya Nyaya Sanhita and Sections 4, 6 of the Protection of Children from Sexual Offences Act.

3. As per F.I.R., these petitioners kidnapped minor daughter of the informant.

4. Learned counsel appearing for the petitioners submits that petitioners are innocent and have committed no

During investigation, victim was recovered and her statement was recorded under Section 183 BNSS wherein she denied the prosecution case and categorically stated that she was in love with Nandan Kumar, who is son of petitioner no. 2 and she fled away with him to Mumbai and solemnized marriage on 27.09.2024. Petitioners have been made accused in this case merely because they happen to be family members of Nandan Kumar. Learned Trial Court has assessed the age of victim between 18-19 years. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering statement of the victim recorded under Section 183 BNSS, this anticipatory bail is allowed and it is ordered that the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 6th District & Additional Sessions Judge-cum-Exclusive Special Judge, POCSO Act, East Champaran, Motihari in connection with Harsidhi P. S. Case No. 506 of 2024, subject to condition as laid
