KUMAR ORAL ORDER 08-06-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 420 of the Indian Penal Code and 27(b)(ii) and 18( c ) of the Drugs and Cosmetics Act.

It has been submitted that from the shop of the petitioner 49 bottles containing 100 ml. each expired Phensedyl syrup were recovered. It is further submitted that recovery of bottles were made from a open space and not from the shop of the petitioner. Petitioner is a bonafide wholesale drug dealer and he never indulged in any kind of illegal activity. He is in jail custody since 8.3.2017.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond

Patna High Court Cr.Misc. No.26566 of 2017 (2) dt.08-06-2017 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Patna, in connection with Kadam Kuan P.S. Case no. 102 of 2017.
