JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-01-2015 Heard learned counsels for the petitioner and the State. The petitioner being the sister of the husband of the complainant is apprehending arrest in a complaint case in which cognizance has been taken for the offences punishable under Sections 323, 504, 406, 379, 498A and 120B of the Indian Penal Code.
The petitioner was earlier granted anticipatory bail vide order dated 14.12.2009 passed in Cr. Misc. No. 6342 of 2009 but the petitioner could not furnish bail bonds.
It is submitted by learned counsel for the petitioner that now the complainant has retracted from his initial version and filed a petition to that effect before the learned court below. Considering the fact that earlier the petitioner was granted anticipatory bail, the present anticipatory bail application
Patna High Court Cr.Misc. No.1464 of 2015 (2) dt.14-01-2015 2/2 is not maintainable.
In view of the fact that the petitioner was earlier granted anticipatory bail on merit and the informant has entered into compromise, this Court sees no reason for the learned court below not to consider the regular bail of the petitioner preferably on the same day if she surrenders within a period of six weeks in connection with Complaint Case No. 2146 of 2007 pending in the court of learned CJM, East Champaran, Motihari. Accordingly, the application is disposed of.
