01-02-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
Petitioner, in the present case, is seeking regular bail in connection with Arwal P.S. Case No. 213/2017 registered for the offence punishable under Sections 366(A) of the Indian Penal Code.
Learned counsel for the petitioner submits that from a combined reading of the statement made in the F.I.R. lodged by the grand-father of the victim girl and the statement made by the victim girl under Section 164 Cr.P.C., the allegation against the present petitioner seems to be false. The petitioner is mother of Mantosh Kumar against whom there are allegations that he had taken away
Patna High Court Cr.Misc. No.4753 of 2018 (2) dt.01-02-2018 the victim girl. The victim girl, in her statement, has stated that she had gone at her own will and volition to Haryana because she did not want to marry with a handicapped groom with whom family members were trying to get her married.
Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal, in connection with Arwal P.S. Case No. 213/2017, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure. (Rajeev Ranjan Prasad, J.) Rajeev/- U T
