JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 379, 304, 504 and 506 of the Indian Penal Code. It is alleged that co-accused Nandlal Chaudhary hurled, abused and caused injury with lathi on the head of the informant and when the informant, his wife, mother and son entered into the house of Radheshyam Prasad for rescue themselves, Nandlal Chaudhary assaulted with garasa on the head of Radhika Devi when other accused persons caused injury to the informant, his wife, son and mother and snatched ornaments, on hearing about the incident, the father of the informant suffered a heart attack and died.
It is submitted by learned counsel for the petitioner that
Patna High Court Cr.Misc. No.1450 of 2015 (2) dt.14-01-2015 2/2 specific accusation of assault is not against the petitioner and the petitioner was not sent up for trial but differing with the final form, the cognizance has been taken. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan in connection with Barharia P.S. Case No. 75 of 2011, subject to the conditions as laid down under Section 438(2) Cr.P.C.
