JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-07-2017 The petitioner seeks regular bail in connection with Pothia P.S. Case No. 28 of 2016, registered for offences punishable under Sections 147, 148, 149, 341, 342, 323, 307, 120B, 186, 189, 353, 333, 504 and 506 of the Indian Penal Code. Prosecution case is that police on informant went to apprehend the petitioner and petitioner tried to flee away and, thereafter, the villager assembled there and attacked the police party.
It has been submitted on behalf of the petitioner that from perusal of the F.I.R itself it will appear that the petitioner has fled away from the spot and it is the villagers, who attacked on the police party. Further petitioner has been in judicial custody since 28.03.2017.
Patna High Court Cr.Misc. No.26704 of 2017 (4) dt.11-07-2017 2/2 Heard learned A.P.P. also.
Having heard both sides, in view of allegations, at present, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected. However, petitioner may renew his prayer for bail after framing of charge in this case or on completion of six months in judicial custody, whichever is earlier.
