JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-03-2016 Learned counsel for the petitioners is not pressing the application with regard to petitioner No. 3 namely Sharda Kumari. Hence, the application of petitioner No. 3 Sharda Kumari is dismissed for not pressed. A slip to that effect has been filed. Let it be kept on record. Petitioner Nos. 1 and 2 being parents of the husband of the complainant are apprehending their arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Sections 323, 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.
The basic accusation is of torture for non-
Patna High Court Cr.Misc. No.10202 of 2016 (3) dt.09-03-2016 2/2 fulfilment of dowry demand.
It is submitted by learned counsel for the petitioners that thrust of accusation is against the husband of the complainant who is ready to keep the complainant with dignity and honour. The petitioners are also ready to keep the complainant with full dignity and honour. A statement to that effect has been made in para 11 of the petition which reads as follows:- "That the petitioners are always ready to keep the complainant with full dignity and affection"
Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Udakishunganj, Madhepura in connection with Complaint Case No. 83 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
