JUSTICE SANJAY PRIYA ORAL ORDER 21-06-2017 Heard learned counsel for the petitioner and the State. Earlier prayer for bail of the petitioner was rejected on merit by this court vide order dated 22-03-2017 passed in Cr. Misc. No. 11557 of 2017.
Counsel for the petitioner submits that the victim girl has already been examined in the lower court during trial. It has also been submitted that the victim girl in her evidence before the trial court has stated that she has performed marriage with this petitioner.
In such circumstances, considering the fact that the trial is going on, this court is not inclined to release the petitioner on bail.
Accordingly, prayer for bail of the petitioner in
Patna High Court Cr.Misc. No.26574 of 2017 (2) dt.21-06-2017 2/2 connection with Hussainganj P.S. Case No. 198 of 2016 corresponding to Sessions Trial No. 232 of 2017 is again rejected. Learned trial court is directed to conclude the trial of the petitioner within six months from the date of receipt/production of copy of this order, giving short adjournments in the case. In case the trial is not concluded within the above said period of six months, the petitioner will be at liberty to renew his prayer for bail in the court below itself.
It is made clear that if trial of the petitioner is not concluded within the above-said period of six months, the court below will send a report to this court giving reason for nonconclusion of trial within the above-said period. (Sanjay Priya, J) A.K.V./- U T
