JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-08-2023 The present writ petition has been filed seeking the following relief:- "1(i). To direct the Respondents No. 3 to 6 for execution of sale deed of the land Mauza-Maiy Khata no. 89 Plot No. 1257 Rakaba-12 decimal in favour of Nityanand Bhagat and same Shrimati Mina Devi both are living village-Maiy, P.O.-Poiti, P.S.-Rafiganj, District-Aurangabad.

In the view facts land is ancestral property of Sanjay Kumar Singh who is executor of this land. This land is coming from his Grand mother and namay/Smt. Devi father's namely Satyabrat

On 2.11.1991 as Ceiling Case No. 72/72- 74 passing in Gazette by District Aurangabad and published Gazette on the name of name of land holder name Smt. Devi W/o Late Jagdish Narayan Singh and Satyabrat Narayan Singh situated at village Maiy, P.S.-Rafiganj, District- Aurangabad after them the Smt. Devi (grand mother of petitioner) and Satyabrat Narayan Singh came before Board of Revenue but no any orders passed in the favour petitioner but Smt. Devi and Satya Brat Narayan Singh prayer before Hon'ble High Court in CWJC No. 8408/1991 and Hon'ble High Court passed order dated 27.9.93 quashed the Gazette and directed to concerned authority for cost Rs. 2500. The petitioner (Sanjay Kumar Singh) deposited all revenue of registration fee before Sub-registrar dated 18/3/19 for registration of sale deed but Respondent no.6 has rejected the same the petitioner is suffering from many decease and want to good education of his son."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law. Liberty, so sought, is granted.
