JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 12-05-2023 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends her arrest in connection with Bahera P.S. Case No. 422 of 2022 registered for the offences punishable under Sections 302 and 328/34 of the Indian Penal Code.
As per the prosecution case, the informant claimed that all the accused persons including the petitioner committed murder of her husband by administrated poison with a view to grab his land.
Learned counsel for the petitioner submitted that petitioner has falsely been implicated in this case. It is submitted that the FIR was lodged under section 302,328/34 of the IPC but after investigation the police submitted charge sheet under
Patna High Court CR. MISC. No.14105 of 2023(2) dt.12-05-2023 2/2 section 306,328/34 of the IPC. It is further submitted that petitioner has clean antecedent as stated in para-3 of this application.
Considering the charge sheet submitted under section 306,328/34 of the IPC as well as submissions of the parties, let the above named petitioner, in the event of her arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 25,000/- (twenty five thousand) each with two sureties of the like amount to the satisfaction of the learned Additional Chief Judicial Magistrate, Benipur, Darbhanga in Bahera P.S. Case No. 422 of 2022, subject to condition as laid down under Section 438(2) of the Cr.P.C.
