This is an application for bail in connection with Dumaria P.S.Case No. 12 of 2015 registered for the offences punishable under Sections 147, 148, 149, 212, 216, 323, 324, 325, 326, 307, 353, 302, 332, 333, 435, 120B, 379 of the Indian Penal Code and 27 of the Arms Act, including Sections 3, 4, 5 of Explosive Substance Act and 17 of C.L.A. Act and Sections 10,11, 13(i), 13(ii) of U.A.P.A. Act.

Petitioner is named in the FIR and allegation against the petitioner is that he exploded bomb causing death of police personnel.

It has been submitted on behalf of the petitioner that there is general and omnibus allegation against the petitioner and other co-accused having similar allegation have been granted regular bail and anticipatory bail by this Court, as contained in Annexures 2 and 3 series and petitioner is in custody for about five months.

No.26564 of 2017 (3) dt.21-06-2017 2/2 Having heard both sides and considering the fact that similarly situated co-accused having been granted bail, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Dumaria P.S.Case No. 12 of 2015, G.R.No. 231 of 2015, subject to the conditions that :- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable properties within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reason, the prosecution is free to move for cancellation of his bail.
