JUSTICE ARUN KUMAR ORAL ORDER 07-02-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant. Petitioner, already in custody, seeks bail in Nokha (Dharampura) PS Case No. 218 of 2017 registered under Sections 147, 148, 149, 341, 323, 324, 307 of the IPC and Section 27 of the Arms Act.
The allegation in brief is that due to land dispute the accused persons assaulted the informant, the allegation against Vijay Singh is that he opened fire but it did not hit anybody and rest two petitioners assaulted with lathi and danda. One Lallu Kumar assaulted over the head of the informant with iron rod.
Learned Counsel for the petitioner submits that there is land dispute and case and counter case between the parties. From the petitioners' side one fire arm injury was caused, specific allegation of giving iron rod blow over head of the informant is against Lallu Kumar and the petitioners are in custody since 9.10.2017 however charge-sheet has been submitted in this case.
Patna High Court Cr.Misc. No.7265 of 2018 (2) dt.07-02-2018 Having considered the said facts and circumstances, the petitioners, namely, Vijay Singh, Dadan Singh and Mahendra Singh are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) by each one of them with two sureties of the like amount each to the satisfaction of ACJM Rohtas in connection with Nokha (Dharampura) PS Case No. 218 of 2017.
