JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 1106 of 2015 in which cognizance has been taken under Sections 323 and 498A of the Indian Penal Code.

Allegation against the petitioner, who happens to be husband of the complainant, as per complaint petition is that he tortured the complainant and ousted her from the house with respect to demand of Rs.1 lac for purchase of she buffalo. Submission of learned counsel for the petitioner is that the whole allegation is false and concocted and he is still ready to keep her with dignity and care and furthermore no specific allegation has been attributed against him. Heard learned APP also.

No.15012 of 2019(5) dt.12-07-2019 2/2 It further appears that in this case notice was issued to opposite party No.2 and office note disclosed that she has received the notice but none has appeared on her behalf nor any Vakalatnama has been filed, which will appear from the order dated 3.7.2019 and as a last indulgence this case was directed to be listed today. However, none appears on behalf of opposite party No.2.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Complaint Case No. 1106 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
