JUSTICE PRABHAT KUMAR JHA ORAL ORDER 14-01-2015 Learned counsel for the petitioner is permitted to make correction in para-10 of the bail petition, in which it has been stated that Nitish Kumar Singh in place of Mannu Kumar @ Nishant Kumar Singh has been enlarged on anticipatory bail. Heard both sides.

The petitioner apprehends his arrest in Mohiuddin Nagar P.S. Case No. 61 of 2014, registered for the offences punishable under Section 366 and some other Sections of the Indian Penal Code. The informant alleged that his wife was kidnapped by one Mannu Kumar @ Nishant Kumar Singh in a Bolero Jeep bearing Registration No. BR09H/2515 for the purpose of marriage. When the informant went to the house of Mannu

Patna High Court Cr.Misc. No.1583 of 2015 (2) dt.14-01-2015 Kumar @ Nishant Kumar Singh his family members assaulted him.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR. The petitioner is a driver of the vehicle bearing Registration No. BR09H/2515, and he plied the jeep on hire. During course of investigation, no material has been collected against the petitioner to show his involvement in the kidnapping.

Considering the facts aforesaid and the fact that the petitioner is a driver of the vehicle and he use to ply the vehicle on hire, he, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Richa Bhargava, the learned Judicial Magistrate 1st Class, Samastipur in connection with Mohiuddin Nagar P.S. Case No. 61 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
