This is an application for bail in connection with Sugauli Rail P.S.Case No. 24 of 2016 registered for the offences punishable under Sections 363 and 365 of the Indian Penal Code. Petitioner is not named in the FIR and later on his name transpires during course of investigation and allegation is of kidnapping of daughter of informant.
It has been submitted on behalf of the petitioner that during course of investigation it has come that the girl has come with the petitioner but she left herself and it is not known to the petitioner about whereabouts of the girl and he is in custody for six months.
Heard learned APP also, who has opposed the prayer
Patna High Court Cr.Misc. No.26712 of 2017 (4) dt.01-08-2017 2/2 for bail on the ground that there are materials available on record that the girl was in the company of the petitioner and she is still traceless.
Having heard both sides and in view of the facts and circumstances and also in view of the fact that the girl is still traceless, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected.
Let the trial be expedited.
