The petitioner seeks bail in Sono P.S. Case No. 315 of 2017 registered under Sections 272 and 273 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition and Excise Act, 2016.
50 litres of country made liquor is said to have been recovered from the house of the petitioner and the petitioner was apprehended.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. The petitioner has no concern with the seized liquor. As a matter of fact, she has been falsely
Patna High Court Cr.Misc. No.2446 of 2018 (2) dt.23-01-2018 2/2 implicated in the case by the police as the police had misbehaved with her husband which was strongly protested by the petitioner. The petitioner happens to be lady. She has no criminal antecedent. She has been languishing in custody since 11.12.2017. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Sono P.S. Case No. 315 of 2017.
