JUSTICE SANDEEP KUMAR ORAL ORDER 13-03-2024 This is the second attempt of the petitioner for grant of regular bail as earlier the bail application of the petitioner has been rejected vide order dated 28.07.2023 passed in Cr. Misc. No. 45705 of 2023.

2. Heard learned counsel for the petitioner and learned APP for the State.

3. The petitioner seeks bail in connection with Baikunthpur P.S. Case No. 103 of 2023 registered for the offence under Section 394 of the Indian Penal Code.

4. As per the prosecution case, loot was committed in the Uttar Bihar Gramin Bank in which Rs. 4,16,000/- and golden chain was looted.

5. It has been submitted by the learned counsel for the petitioner that there is no recovery from the petitioner and the petitioner has not been put on T.I. Parade. He also submits that the other co-accused persons have already been granted bail by this Court.

6. Learned counsel for the petitioner further submits that the petitioner has clean antecedents and he is in custody since 8.4.2023.

7. Learned APP for the State has vehemently opposed the prayer of the petitioner for grant of bail.

8. Considering the aforesaid facts, this application is allowed.

9. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Baikunthpur P.S. Case No. 103 of 2023.

10. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Paru Police Station on every Sunday of the month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.
