The petitioner seeks regular bail in connection with Erkha Check Post Excise Case No. 72 of 2017, registered under Section 30(a) of Bihar Prohibition and Excise Act, 2016. The allegation leveled against the petitioner is with regard to recovery of illicit liquor from his motor cycle, while the petitioner was apprehended.

Learned counsel for the petitioner submits that he is not the owner of the Motor Cycle and nothing was recovered from the possession of the petitioner.

It is further submitted that the petitioner has no criminal antecedent and is in custody since 22.04.2017.

No.27087 of 2017 (2) dt.15-06-2017 2/2 Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Court-Excise Act, Aurangabad, in connection with Erkha Check Post Excise Case No. 72 of 2017.
