NATH ORAL JUDGMENT Date: 27-01-2015 The learned counsel for the petitioner, after some argument, has confined his prayer for a direction to the learned court below to dispose of the pending petition filed on behalf of the plaintiff under Order 39 Rule 1 and 2 C.P.C. praying for injunction restraining the defendants from changing the physical feature of the suit land by making construction over the same.
It transpires from Annexure-3 of the writ application that the injunction petition has been filed on behalf of the plaintiff on 26.06.2013 and according to the case of the petitioner the same is still lying pending before the court without any order. In the aforesaid backdrop of the facts and after
Patna High Court CWJC No.1110 of 2015 dt.27-01-2015 considering the submissions, this application is disposed of with a direction to the learned court below to dispose of the injunction petition dated 26.06.2013 (Annexure-3) expeditiously and without unnecessary delay preferably within three months from the date of receipt/production of this order.
It is noted that this order has been passed without hearing the other side as in view of the nature of the order, this Court finds that the notice to the respondents is not required. (V. Nath, J) Devendra/- U
