Heard learned counsel for the petitioner and the learned A.P.P. for the State The petitioner is languishing in jail since 17.12.2016 in a case registered for offences punishable under Sections 498(A), 379, 341, 323, 504, 506 of the Indian Penal Code read with Sections 3/4 of Dowry Prohibition Act.

The prosecution case as lodged by the wife, who is the informant, is that her husband and in inlaws have tortured her and turned her out of her matrimonial house many times for non fulfillment of demand of dowry.

No.26965 of 2017 (3) dt.11-07-2017 2/2 It has been submitted by learned counsel for the petitioner that he is innocent and is ready to keep his wife with dignity and honour and he does not bear any criminal antecedent. However, learned A.P.P. for the State opposes the prayer for bail.

Considering the facts and circumstance of the case and materials on record, let the petitioner above named, be released on provisional bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Nawada in connection with Nawada Town P.S.Case No. 46 of 2016, subject to the condition that the petitioner will appear before the learned S.D.J.M., Nawada on 26th July, 2017 and the learned Court below after noticing the informant, wife of the petitioner shall confirm the bail on three eventualities :- i) the petitioner is ready to take the informant, his wife to her matrimonial house with full dignity and harmony ii) even after notice the informant does not appear and iii) the informant is reluctant to resolve the issue.
