The petitioner seeks bail in a case registered under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that co-accused Chandrashekhar @ Shekhar fired at informant's father-in-law hitting his chest, who succumbed to the injuries. Thereafter the accused persons including the petitioner threatened the informant and his wife to maintain silence otherwise they would also be killed. It has been submitted on behalf of the petitioner that the petitioner is in custody since 07.12.2018. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. Specific allegation of

Patna High Court CR. MISC. No.13147 of 2019(5) dt.22-08-2019 2/2 assault is alleged against Chandrashekhar @ Shekhar, who is said to have fired upon the deceased. No allegation of assault is alleged against the petitioner. The petitioner is said to be a member of unlawful assembly. Except for this, there is no other substantive evidence to suggest his implication in the present case. Other co-accused has been granted bail vide Cr.Misc.No.13472 of 2019.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda in connection with Giriyak P.S. case No.246 of 2018.
