JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 05-04-2016 Heard Mr. Sanjeev Kumar Mishra, the counsel for the petitioners and Mr. A.N. Pandit, APP for the State. The petitioners are seeking anticipatory bail in connection with Protest cum Complaint Case No. 184 of 2015 arising out of Sasaram Model P.S. Case No. 575 of 2010, registered under Section 302/34 of the Indian Penal Code. The petitioners are the father-in-law and the mother-inlaw respectively of the victim, who died from burn injury while cooking food. It is stated that the lady was carried to the hospital to afford all medical assistance. Her statement was also recorded by the Judicial Magistrate in which she did not allege anything
Patna High Court Cr.Misc. No.12903 of 2016 (2) dt.05-04-2016 2/2 against the petitioners. The police ultimately found a case of accident. Later on protest, the cognizance was taken. Considering the above, other accused persons in the said case have been released on anticipatory bail by this Court. Mr. Mishra has handed a web-copy of the order dated 30.03.2016 passed in Cr. Misc. No. 12884 of 2016, which is taken on record and marked 'Y' for identification.
In the facts and circumstances of the case, let the petitioners above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram in P.S. Case No. 575 of 2010 on condition that one of the bailors shall be his/their own/close family member. The petitioners shall appear on each date fixed at the trial. In case of default in appearance on two consecutive dates, the trial court shall have liberty to cancel their bail bonds. (Kishore Kumar Mandal, J) rohit/- U T
