JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-07-2017 The petitioner seeks bail in connection with Korha P.S. Case No. 255 of 2016 registered for offences punishable under section 302/34 of the Indian Penal Code. The allegation against the petitioner is that the sister of the informant namely Reena Devi went to the house of petitioner Yogendra Uraon, where petitioner and co-accused Rooma Devi brutally assaulted her and also confined her in a room. After knowing the fact the informant went there, but they refused to hand over her to the informant. Thereafter, his sister was sent to home on deteriorating condition and on 09.11.2016 she died, and sign of assault on her neck and back was seen by the informant.
It has been submitted on behalf of the petitioner that there is
Patna High Court Cr.Misc. No.26590 of 2017 (4) dt.17-07-2017 2/2 no eye witness to the occurrence of Mar Pit nor is there any witness to anything. It has been further stated that co-accused Room Devi has been granted bail by a coordinate bench of this Court vide order dated 03.05.2017 passed in Criminal Miscellaneous No. 21432 of 2017 It has been further stated that petitioner is in custody since 11.11.2016.
Having heard both sides, in view of the facts and circumstances of the case, I am not inclined to grant bail to the petitioner. However, learned Sessions Judge, Katihar is directed to conclude the trial within a period of 9 months. With the above observation, this application is dismissed.
