Petitioner, already in custody, seeks bail in connection with Sour Bazar P.S. Case No.174 of 2017, registered under Sections 307/34 of the Indian Penal Code as well as under Section 27 of the Arms Act.

Allegation in brief is that while the informant was going on motorcycle along with his cousin then the petitioner followed him sitting on a motorcycle as a pillion rider and shot aiming the informant but it hit his cousin in his hand and the cousin of the petitioner fell down thereafter the petitioner escaped away.

Learned counsel for the petitioner submits that the informant and petitioner are co-villagers and the petitioner

Patna High Court Cr.Misc. No.10045 of 2018(4) dt.03-04-2018 2/2 intended to cause injury to the informant, the injury is on the hand of the victim, both sides have compromised the case and the petitioner is in custody approximately for the last one year. Having considered the specific allegation against the petitioner of shooting at the victim causing firearm injury, the prayer of bail of the petitioner is rejected in connection with Sour Bazar P.S. Case No.174 of 2017, pending in the court of learned CJM, Saharsa with a direction to the trial court to expedite the trial.
