The petitioner seeks regular bail in connection with Nardiganj P.S. Case No. 236 of 2020 registered for the offence under Sections 341, 323, 379, 504, 506, 34 of the IPC and Section 27 of the Arms Act.

The prosecution case is that when the informant was coming back to his house, the petitioner along with co-accused having pistol in their hands started assaulting him and on protest, the petitioner shot fire with pistol due to which the informant sustained injury on finger of left hand. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is next door neighbour and some disputes going on

Patna High Court CR. MISC. No.14514 of 2022(3) dt.02-01-2023 2/2 between the parties due to which the petitioner has falsely been implicated in this present case. A statement has been made in para 3 of the petition that the petitioner got no criminal antecedent. It is further submitted that injury sustained by informant is on finger which is not a vital part and injury is not dangerous for life. Petitioner is languishing in judicial custody since 12.01.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Nardiganj P.S. Case No. 236 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Nawada.
