JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-07-2017 The petitioner seeks regular bail in connection with Roh P.S. Case No. 60 of 2016, registered for offences punishable under Sections 147, 149, 307, 379, 504 of the Indian Penal Code. Allegation against the petitioner is of firing on the informant causing injury to him.

It has been submitted on behalf of the petitioner that he has falsely been implicated in the present case and he has been arrested in another case and, thereafter, remanded in the present case. Further petitioner has been in judicial custody since 07.10.2016 and so far criminal antecedents of the petitioner is concerned, he is on bail in all other cases.

Learned counsel for the State opposed the prayer for bail and submitted that there is fire arm injury on the chest of the

Having heard both sides, considering the facts and circumstances of the case, nature of allegation I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.

However, since the petitioner has been in custody for last nine months, the trial court is directed to commit the case and expedite the trial and try to conclude it within a period of six months from the date of commitment.
