NILU AGRAWAL ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
Learned counsel for the petitioner submits that a condition was imposed while granting bail to the petitioner vide order dated 31.07.2017 in connection with Warsaliganj P.S. Case No. 14 of 2017 to the satisfaction of learned Chief Judicial Magistrate, Nawada that "one of the bailors would be a close relative of the petitioner having sufficient immovable property within the jurisdiction of the concerned police station, who will file an affidavit stating his relationship with the petitioner". He submits that the petitioner is a resident of Muzaffarpur and he has no close relative within the jurisdiction of Nawada or Warsaliganj P.S., hence, prays for deletion of the said condition.
Patna High Court Cr.Misc. No.26982 of 2017 (5) dt.10-08-2017 2/2 Accordingly, lines "having sufficient immovable property within the jurisdiction of the concerned police station" is deleted and the order dated 31.07.2017 is modified to the extent indicated above.
