Petitioner, already in custody, seeks bail in connection with Amarpur P.S. Case No.471 of 2017, registered under Sections 392 and 411 of the Indian Penal Code.
Allegation in brief is that while the informant was going to his home after withdrawing Rs.5000/- from the bank, then FIR named accused persons after snatching the money started escaping away but chased by the local people and apprehended, from possession of the another co-accused Santosh Kumar Sah, Rs.5000/-, looted money, was recovered.
Learned counsel for the petitioner submits that recovery is from Santosh Kumar Sah and not from this petitioner and the petitioner has clean antecedent.
Patna High Court Cr.Misc. No.4242 of 2018(2) dt.01-02-2018 2/2 Learned counsel for the State submits that the petitioner was apprehended just near the spot after chasing and recovery is also made from co-accused.
Having considered the said facts and circumstances, the prayer of bail of the petitioner is rejected in connection with Amarpur P.S. Case No.471 of 2017, pending in the court of learned CJM, Banka.
However, the petitioner may renew his prayer of bail after six months.
