2. The petitioner has renewed his prayer for regular bail in connection with Kharagpur(Shampur) P.S. Case. No. 272 of 2022 which was earlier dismissed as withdrawn by this Court on behalf of learned counsel for the petitioner on the basis of report dated 30.10.2023 which suggested that the trial would be concluded within a period of 3 months and trial Court was directed to conclude the trial within the stipulated period of time as mentioned in its report failing which the petitioner would be at liberty to renew his prayer for bail.

3. Learned counsel for the petitioner submitted that the trial has not been concluded as yet despite the direction of

Patna High Court CR. MISC. No.15925 of 2024(3) dt.02-05-2024 2/3 this Court vide order dated 19.12.2023 to conclude the trial. Learned Counsel for the petitioner further submitted that petitioner is languishing in judicial custody since 05.09.2022.

4. From perusal of the impugned order dated 06.02.2024, the trial has not been concluded as yet.

5. Considering the aforesaid facts and circumstances of this case as well as the custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kharagpur (Shampur) P.S. Case No. 272 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Munger subject to following conditions:-

6. (i) Petitioner shall co-operate in the trial and shall be present on each and every fixed date and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below.

7. (ii) If the petitioner tampers with the evidence or threatens the witnesses, in that case, the prosecution will be at liberty to move of cancellation of bail.

8. (iii) In case, the petitioner repeats offence of similar nature after enlargement on bail, his bail-bonds will be cancelled by the Court below.
