JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 23-07-2015 Heard Both the applications arise out of Kinjar P.S. Case No. 18 of 2014 registered under Sections 304B, 201 and 34 of the Indian Penal Code and, as such, they have been placed together for consideration and are being disposed of by the present order. The petitioners of 38013 of 2014 are the mother-in-law,

Patna High Court Cr.Misc. No.38013 of 2014 (6) dt.23-07-2015 2/2 brother-in-law and father-in-law of the deceased whereas petitioner of Cr. Misc. No. 2648 of 2015 is the husband of the deceased. The F.I.R. alleges that the marriage of the victim was solemnized with Arbind Singh @ Arbind Kumar Singh in the year 2010 whereafter she was continually tortured, both mentally and physically, on account of non-fulfilment of demand of dowry. Ultimately, she was done to death in mysterious circumstances in the matrimonial home. The Counsel for the petitioners has submitted that the deceased was suffering from illness and was treated previously at the hospital. She died a natural death. Mr.

Dayal, APP, on the other hand, points out from the case diary that in course of investigation, the several witnesses have supported the allegations levelled against the petitioner(s). The impugned order also discloses that the investigation reports contain material in support of the allegation. Considering the seriousness of the allegation and the facts appearing from the record, I am not persuaded to privilege them with anticipatory bail. Prayer is, accordingly, rejected. Petitioners may surrender and seek bail in the Court below.
