25-03-2015 Heard Sri Bindhyachal Singh, learned counsel, who was assisted by Sri Vipin Kumar Singh, learned counsel for the petitioner and Sri Suresh Pd. Singh, learned A.P.P. The present petition has been filed with a prayer to restore Cr. Misc. No. 24702 of 2014, which stood dismissed due to non-compliance of peremptory order dated 13-08-2014. By the said order, while directing for issuance of notice to opposite party no. 2 to 4, the requisites were directed to be filed within ten days peremptory.

Learned counsel for the petitioner states that ofcourse, requisites were filed within time in respect of opposite party no. 2, however; due to mistake, requisites in respect of remaining opposite parties were filed after the peremptory time. In view of facts and circumstances, the present petition stands allowed.

Patna High Court Cr.Misc. No.3509 of 2015 (3) dt.25-03-2015 2/2 Let Cr. Misc. No. 24702 of 2014 be restored to its original file.
