Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 304B of the Indian Penal Code. Allegedly, petitioner and his family members committed dowry death of the informant's daughter by strangulating on account of their demand of golden chain and ring having been not fulfilled by the victim.
The main submissions advanced by the learned counsel for the petitioner are that petitioner has been languishing in jail since 6.8.2021 and against him there is no specific allegation or having specific role in the commission of dowry death. Further submission
Patna High Court CR. MISC. No.13573 of 2022(2) dt.11-07-2022 2/2 is that the petitioner is a government employee serving as an assistant teacher and not only him but his family members have been made accused in this case. Further submission is that in fact, deceased committed suicide by hanging.
Learned APP opposes the prayer for bail.
Heard both sides and perused the FIR. Against the petitioner there is no specific allegation in the FIR, any specific role or act of the petitioner in the commission of dowry death has not been revealed by the informant and as per order of the learned court below, investigation has been completed in respect of the petitioner. Considering these facts as well as above submissions and also the fact that petitioner is stated to be father-in-law of the deceased and as per his petition he is aged about 62 years, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Uday Pratap, Judicial Magistrate Ist Class, Gopalganj/ concerned court in Baikunthpur P.S Case No. 235 of 2021.
