JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-06-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in connection with Khagaul P.S.Case no. 63 of 2017 registered under Sections 30(A) of Bihar Madhya Nisedh and Excise Act, 2016.
The allegation against the petitioner is that he was standing at the place of occurrence from where alleged foreign liquor was seized from a truck of Abhisekh Kumar and Manoj Kumar.
Learned counsel for the petitioner submits that perusal of FIR would show that the petitioner was standing there. Admittedly, recovery has been made from the truck, which is not belonging to the petitioner. It is further submitted that the petitioner does not have any criminal antecedent and he is in
Patna High Court Cr.Misc. No.27002 of 2017 (2) dt.14-06-2017 2/2 custody since 09.05.2017.
Having regard to the facts and circumstances of the case I deem it fit and appropriate to enlarge the petitioner on bail. Accordingly, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in Khagaul P.S.Case No. 63 of 2017 (Special Case No. 1242 of 2017).
