Petitioner seeks bail in connection Excise Case no. 329 of 2018 registered for the offence punishable under sections 30(a) and 36 of Bihar Prohibition and Excise Amendment Act, 2018.

Learned counsel for the petitioner submits that the petitioner is in custody since 25.01.2021, charge sheet has been submitted and there are three cases against the petitioner of similar nature as mentioned in para 3 of the petition. Learned counsel for the petitioner next submits that from perusal of the allegation as alleged in the FIR, it would manifest that 2868.480 liter foreign liquor was recovered from bush at the distance of

Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioner is in jail custody since 25.01.2021 and charge sheet has been submitted, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ADJ II-cum- Special Judge, Excise, Rohtas, at Sasaram in Excise Case no. 329 of 2018.
