Petitioner, already in custody, seeks bail in connection with Hathauri P.S. Case No. 124 of 2017, registered under Sections 272 and 273 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016. The allegation in brief is that huge amount of illicit foreign liquor was recovered from the house of the petitioner. Learned counsel for the petitioner submits that the alleged recovery of foreign liquor was from the south east corner of the house of other person and not from the possession of the petitioner. However, the petitioner is in custody since 20.11.2017. Having considered the said facts and circumstances,

Patna High Court Cr.Misc. No.3881 of 2018 (2) dt.25-01-2018 2/2 the petitioner, Kanhai Ojha, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge-cum- Special Judge, Excise Act, Muzaffarpur in connection with Hathauri P.S.Case No. 124 of 2017.
