JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner seeks bail in connection with Ujiyarpur P.S. Case No.06 of 2020/Computer Reg. No.29 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The accusation is that on receiving the secret information about doing the business of illicit liquor by Shiv Kumar Ram (petitioner), Ram Karan Mahto and Nitish Kumar alias Munna, in villlage-Baikunthpur Brahanda, the informant along with other police personnel reached there and on search of the hut of the cattle of the petitioner, 2016 bottles, each containing 180 ml., 215 bottles, each containing 375 ml., and
Patna High Court CR. MISC. No.14163 of 2020(3) dt.15-06-2020 2/2 168 bottles, each containing 750 ml., total in the volume of 881.235 liters Indian Made Foreign Liquor, were recovered. Learned counsel appearing on behalf of the petitioner submits that the petitioner has no criminal antecedent and is in custody since 06.01.2020. Further submission is that it would appear from the F.I.R. that the seized bottles of liquor are said to be recovered from the open place and not from the house of the petitioner.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge (Excise), Samastipur, in connection with Ujiyarpur P.S. Case No.06 of 2020//Computer Reg. No.29 of 2020. (Rajendra Kumar Mishra, J) P.S./- U T
