Heard learned counsel for the petitioner and learned APP for the State.
The petitioner has preferred this application for grant of regular bail in a case registered under section 341, 342, 307, 120(B) and 34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner is to fire at the back of the Shivam Kumar and co-accused also fired which hit on the back of the Shivam Kumar.
Patna High Court CR. MISC. No.13161 of 2022(2) dt.18-07-2022 2/3 Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is also accused in five other criminal cases. The petitioner is in custody since 15.12.2021. Learned counsel further submits that two rounds of firing were made by the petitioner and co-accused person but only one injury was found on the person of injured though the injury is grievous in nature.
Learned A.P.P. for the State has opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Rajeev Ranjan, learned Judicial Magistrate-Is Class, Begusarai, in connection with Nowkothi P.S. Case No. 89 of 2021 of 2021, with a following condition :- (I) That the petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable
