The petitioner apprehends his arrest in Chhatauni P.S. Case No. 179 of 2013, registered for the offences punishable under Section 406 and other Sections of the Indian Penal Code and Section 138 of the Negotiable Instrument Act. The complainant alleged that the petitioner took Rs. 2.5 Lacs for smooth running of a business but the petitioner did not return the amount. The accused Pintu Chaudhary gave the informant a cheque of Union Bank of India on 15.12.2012, but the cheque was dishonoured.
It is submitted that the petitioner is father of Pintu Chaudhary. The son of the petitioner runs a business and he never

Considering the facts aforesaid and the fact that the petitioner neither received any money nor issued any cheque and the dispute appears to be of civil nature, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Chhatauni P.S. Case No. 179 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
