05-03-2020 Heard learned counsel for the parties.

The petitioner apprehends his arrest in Chowk P.S. Case No. 423 of 2019 registered for the offence under Section 307 & other allied sections of the Indian Penal Code and Section 27 of the Arms Act.

It is submitted on behalf of petitioner that specific allegation of causing fire-arm injury is against co-accused. So far as this petitioner is concerned, there is general and omnibus allegation. No case under Section 307 I.P.C. and Section 27 of the Arms Act is made out against this petitioner. It is further submitted that there is no injury report. Petitioner is having no criminal antecedent.

Considering the aforesaid facts and circumstances as well as nature of accusation, in the event of his arrest/surrender

Patna High Court CR. MISC. No.13318 of 2020(2) dt.05-03-2020 2/2 within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- II, Patna City (Patna) in connection with G.R. No. 6170 of 2019, arising out of Chowk P.S. Case No. 423 of 2019, subject to condition as laid down under Section 438(2) of the Cr.P.C.
