JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-05-2022 Heard Mr. Arvind Kumar, learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Belaganj P.S. Case No. 34 of 2020 dated 30.01.2020 instituted for the offences under Sections 341, 323, 354, 307, 378, 504 and 34 of the Indian Penal Code. The accusation against the petitioner and others is of having taken part in the assault which has led to injuries on some of the persons.

The learned counsel for the petitioner, however, has submitted that there is no specific accusation against the petitioner and that there is a land dispute between the parties. There is a counter version of the occurrence also vide Belaganj P.S. Case No. 35 of 2020 which has been lodged by the mother

Patna High Court CR. MISC. No.24644 of 2021(2) dt.25-05-2022 2/2 of one of the petitioners against the informant. The injuries suffered by the victims have been stated to be simple in nature. Considering the afore-noted facts and further taking into account the clean antecedents of the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateXI, Gaya in connection with Belaganj P.S. Case No. 34 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
