The petitioner is a licensee under the Public Distribution System (Control) Order, 2001 as enforced in the State of Bihar vide Fair Price Shop Order, 2007 (hereinafter referred to as 'the Control Order'). The licence of the petitioner bearing no.79 of 2007 was cancelled by the Licensing Authority -cum- Sub-Divisional Officer, Udakishunganj vide order bearing Memo No.1924-2 dated 6.8.2014, a copy of which is placed at Annexure-5 to the writ petition.

The grievance of the is that although he has filed statutory appeal under the provisions of 'the Control Order' before the District Magistrate, Madhepura bearing Appeal No.11 of 2014 but the same has not been disposed of and hence the

Patna High Court CWJC No.842 of 2015 (2) dt.19-03-2015 writ petition.

Having heard learned counsel for the parties and taking note of the nature of grievance the writ petition is disposed of with a direction to the District Magistrate, Madhepura to consider and dispose of the Appeal No.11 of 2014 in accordance with law and after giving opportunity of hearing to the petitioner expeditiously and preferably within a period of three months from the date of receipt/production of a copy of this order.
