JUSTICE SANJAY PRIYA ORAL ORDER 2/ 06-03-2019 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the informant. Petitioner seeks bail in Gogari P.S. Case No.364 of 2018 instituted for the offence under Section(s) 341, 323, 448, 379, 504, 506/34 Indian Penal Code and Section 27 of the Arms Act.

It is alleged in the written report that on the date of occurrence co-accused, Veer Prakash Yadav assaulted the informant with fists and slaps. This petitioner took out rupees two thousand from his pocket.

Counsel for the petitioner submits that petitioner and informant are Gotiyas and case has been filed due to admitted land dispute.

Petitioner is in custody since 20.01.2019.

Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Gogari P.S. Case No.364 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
